The Automatic Domestic Standing Order
As soon as a divorce complaint has been filed and served, a standing order goes into effect. Standing orders in divorce ensure that each party acts legally, and does not threaten or sabotage the other party. At The Siemon Law Firm, we have helped many clients navigate the standing order document and have educated them on the correct behavior to be exhibited throughout the proceeding.
"This order concerns all cases which are filed in the Family Division of the Superior Court of Fulton County and remains in effect as long as the case is pending. Where this order requires or prohibits a party from doing a thing, it means that a party shall neither do the thing, instruct, encourage or cause others to do the thing, act together with others in doing the thing or ask another to do the thing on the party's behalf." Introduction to the Automatic Domestic Standing Order
The standing order is a document the court uses to ensure each party acts appropriately. Many situations are described, including:
- "Each party is hereby enjoined and restrained from doing, or attempting to do, or threatening to do, any act injuring, maltreating, vilifying, molesting, or harassing the adverse party or the child(ren) of the parties."
- "Each party to a divorce or separate maintenance action is hereby enjoined and restrained from selling, encumbering, trading, contracting to sell, or otherwise disposing or removing from the jurisdiction of the court, any of the property belonging to the parties except in the ordinary course of business."
And so on. The standing order was created to protect each party from the vindictive or jealous actions that might accompany the strong feelings associated with a divorce. A lawyer at our firm can explain the standing order in greater detail through a confidential consultation.
