Equitable Property Division

Marital property is property obtained during the marriage. It is considered to be owned by both spouses. There are certain exceptions where one spouse owns property obtained during the marriage, including personal gifts and inheritances.

Today in Georgia, marital property is subject to equitable division. Instead of splitting property 50/50, the court will make a determination of what is fair by considering many factors such as:
