The Divorce Process in Fulton County

- File for divorce: The first legal step is to file for divorce. When this happens, the other spouse is served papers by a private process server or the Sheriff's office. It is also possible for the other party to acknowledge service of the papers before a notary public. When a client of ours files, we provide an information packet that describes the process and contains the standing order and the mandatory discovery questions.
- Standing order: Once the divorce is filed and served, the standing order goes into effect.
- 30 day status conference: 30 days after you file a complaint for divorce in Fulton County, the court schedules a 30 day status conference. The purpose of this meeting is to ensure that progress is being made and that the parties are exchanging the necessary mandatory discovery. The parties are instructed to bring their completed mandatory discovery paperwork and exchange at this conference.
- 60 day status conference: 60 days after a divorce complaint is filed, the court schedules a 60 day status conference. The purpose of this meeting is to discuss any issues that might have arisen since the 30 day status conference. Again, it is necessary that each party show progress and a willingness to work with each other.
- 120 day status conference: The court schedules a 120 day status conference as a scheduling conference for trial. The judge will determine who needs what for the trial, and when the trial will begin and how long it should take.
It is important to remember that this process can be completed at any stage through mediation. If the two parties work through, and resolve, any disputes such as property division or child custody on their own, they do not need the assistance of the court.
